These Terms of Service (“Terms”) govern your access to and use of the website iguardfire.com, the iGuard™ mobile application, and the purchase and use of iGuard™ products and services provided by iGuard Home Inc. (USA) and iGuardFire Ltd. (Canada) (collectively, “iGuard Home,” “we,” “our,” or “us”).

By accessing our website, placing an order, creating an account, or using an iGuard™ product, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website, products, or services.

Eligibility

You must be at least eighteen (18) years of age, or the age of majority in your province, territory, or state of residence, to use our website, purchase iGuard™ products, or create an account. By using our website or placing an order, you represent and warrant that you meet this requirement.

Products and Orders

All product descriptions, images, specifications, and other information on iguardfire.com are provided for informational purposes and are subject to change without notice. iGuard Home makes reasonable efforts to ensure the accuracy of product information but does not warrant that product descriptions or other content are error-free.

iGuard Home reserves the right to limit the quantity of products available for purchase, to refuse or cancel any order, and to discontinue any product at any time. If an order is cancelled after payment has been processed, iGuard Home will issue a full refund to the original method of payment.

An order confirmation does not constitute acceptance of your order. iGuard Home accepts your order when the product is shipped. Until that point, iGuard Home may cancel or modify the order at its discretion.

Pricing and Payment

All prices displayed on iguardfire.com are in the applicable currency for your region (U.S. dollars for customers in the United States and Canadian dollars for customers in Canada) and are subject to change without notice. Prices do not include shipping, handling, or applicable taxes, which will be calculated and displayed at checkout.

iGuard Home accepts payment via major credit cards and debit cards through Stripe. PayPal, including Buy Now Pay Later options, is available for customers in the United States only.

For certain products, iGuard Home may offer a deposit or reservation option that allows you to secure your order by paying a portion of the purchase price at the time of order, with the remaining balance due before or at the time of shipment. The specific deposit amount and payment terms will be displayed at checkout.

iGuard Home uses third-party payment processors to handle transactions. iGuard Home does not store your full credit card or payment account information on its servers. All payment processing is subject to the terms and privacy policies of the applicable payment processor.

Taxes

For orders shipped within Canada, applicable federal Goods and Services Tax (GST) or Harmonized Sales Tax (HST) will be charged according to the province or territory to which the product is shipped. Provincial sales taxes are applied where required by law.

For orders shipped within the United States, applicable state and local sales taxes will be calculated and collected as required by law.

You are responsible for any additional duties, import taxes, or fees that may apply to your order.

Shipping and Delivery

iGuard Home ships iGuard™ products to addresses in the United States and Canada. Shipping costs are calculated based on the weight of your order, the shipping method selected, and the delivery destination. All shipping charges will be displayed at checkout before you complete your order.

An estimated delivery time will be provided when your order is placed. Delivery times are estimates only and commence from the date of shipment, not the date of order. iGuard Home makes every reasonable effort to fulfill orders within fifteen (15) business days of the date of order, unless otherwise communicated. Business days are Monday through Friday, excluding holidays recognized in the applicable jurisdiction.

Actual delivery dates may vary due to carrier practices, delivery location, shipping method, and product availability. iGuard Home is not responsible for delays caused by the shipping carrier or circumstances beyond its reasonable control.

Risk of loss and title to products pass to you upon delivery of the product to the shipping carrier.

Damaged in Transport

If your iGuard™ product arrives with visible damage to the packaging or the product itself, please refer to the Damaged in Transport section of our Refund and Return Policy at iguardfire.com/returns for instructions on how to report the damage and obtain a resolution.

Returns, Refunds, and Exchanges

All returns, refunds, deposit cancellations, and exchanges are governed by iGuard Home’s Refund and Return Policy, available at iguardfire.com/returns. Key provisions include:

  • a 30-Day Satisfaction Guarantee for products returned in good condition;
  • a 15% restocking fee on satisfaction guarantee returns, where permitted by applicable law;
  • full refund of deposits cancelled prior to shipment;
  • exchanges of one iGuard™ model for another within thirty (30) days; and
  • all returns require a Return Material Authorization (RMA) number before shipping.

Product Warranty

iGuard™ products are covered by iGuard Home’s Limited Product Warranty, available at iguardfire.com/warranty. The warranty provides coverage for defects in materials and workmanship for a period of one (1) year from the original date of purchase, subject to the terms and conditions set forth in the warranty.

Except as expressly set forth in the Limited Product Warranty, iGuard Home makes no other warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by applicable law.

Subscription Services

iGuard Home may offer optional subscription services that provide enhanced features and functionality for your iGuard™ product. The specific features, pricing, and terms of each subscription plan are described on iguardfire.com at the time of purchase or enrollment.

Subscription services are governed by the terms presented at the time of enrollment. Cancellation of subscription services is subject to the terms set forth in the Refund and Return Policy at iguardfire.com/returns.

iGuard Home reserves the right to modify subscription features, pricing, or availability upon reasonable notice to subscribers. Any material changes to subscription terms will be communicated to you in advance, and your continued use of the subscription after the effective date of the changes constitutes acceptance of the modified terms.

Account Registration

Certain features of the iGuard™ product and services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify iGuard Home immediately of any unauthorized use of your account.

iGuard Home reserves the right to suspend or terminate your account if it reasonably believes that your account has been compromised or that you have violated these Terms.

Privacy

iGuard Home’s collection, use, and disclosure of your personal information is governed by our Privacy Policy, available at iguardfire.com/privacy. By using our website, products, or services, you acknowledge that you have read and understood the Privacy Policy.

Intellectual Property

All content on iguardfire.com, including but not limited to text, images, graphics, logos, product designs, software, and documentation, is the property of iGuard Home or its licensors and is protected by Canadian and United States copyright, trademark, patent, and other intellectual property laws.

iGuard™ is a trademark of iGuard Home Inc. The iGuard™ product incorporates patented technology protected by United States patents. Unauthorized reproduction, modification, distribution, or use of iGuard Home’s intellectual property is prohibited.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use iguardfire.com and the iGuard™ mobile application for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, or sell any content or software obtained from or through iGuard Home.

Software and Firmware

The iGuard™ product includes embedded software and firmware that is licensed, not sold, to you. iGuard Home retains all right, title, and interest in and to the software and firmware. You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of any software or firmware included with the iGuard™ product.

iGuard Home may from time to time release firmware updates to improve product functionality, security, or performance. By connecting your iGuard™ device to the internet, you consent to the automatic download and installation of firmware updates. Certain updates may be required for continued use of connected features.

Prohibited Uses

You agree not to use iguardfire.com, the iGuard™ mobile application, or any iGuard™ product for any purpose that is unlawful or prohibited by these Terms, including but not limited to:

  • attempting to gain unauthorized access to any part of the website, application, device, or iGuard Home’s systems or networks;
  • using any automated means, including bots, scrapers, or spiders, to access or collect data from the website or application;
  • interfering with or disrupting the operation of the website, application, or any iGuard™ device;
  • modifying, tampering with, or disabling any iGuard™ device or its safety features;
  • using the website, application, or device in any manner that could damage, disable, or impair iGuard Home’s services; or
  • violating any applicable local, state, provincial, national, or international law or regulation.

Product Safety Disclaimer

The iGuard™ product is designed to enhance cooking safety by detecting unattended cooking activity and automatically shutting off the stove. While iGuard Home makes every reasonable effort to ensure the reliability of its products, the iGuard™ device is not a substitute for safe cooking practices, functioning smoke detectors, fire extinguishers, or other fire safety measures.

iGuard Home does not guarantee that the iGuard™ device will prevent all cooking fires or eliminate all risks associated with cooking. Users should always follow safe cooking practices and maintain all recommended fire safety equipment in their homes.

The iGuard™ device is intended for residential use with standard residential stoves. Use of the device with commercial or industrial cooking equipment is not recommended and is not covered by the Limited Product Warranty.

Limitation of Liability

To the maximum extent permitted by applicable law, iGuard Home shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including but not limited to loss of use, loss of data, loss of profits, business interruption, property damage, or personal injury arising from or related to your use of or inability to use the website, application, or any iGuard™ product, even if iGuard Home has been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, iGuard Home’s total cumulative liability arising from or related to these Terms, the website, the application, or any iGuard™ product shall not exceed the amount you paid to iGuard Home for the specific product or service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, iGuard Home’s liability shall be limited to the greatest extent permitted by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless iGuard Home, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to your violation of these Terms, your use of the website, application, or any iGuard™ product, or your violation of any applicable law or the rights of any third party.

Third-Party Links and Services

The iGuard Home website and application may contain links to third-party websites, services, or content that are not owned or controlled by iGuard Home. iGuard Home is not responsible for the content, privacy policies, or practices of any third-party websites or services. Inclusion of a link does not imply endorsement by iGuard Home.

If your iGuard™ device integrates with third-party platforms or services (such as home security systems or smart home platforms), the use of those platforms is governed by the respective third party’s terms of service and privacy policy. iGuard Home is not responsible for the data practices of third-party platforms that receive data from your iGuard™ device through authorized integrations.

Force Majeure

iGuard Home shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond iGuard Home’s reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, supply chain disruptions, government actions, power failures, or internet outages.

Governing Law

For customers in the United States, these Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

For customers in Canada, these Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law provisions.

Dispute Resolution

iGuard Home encourages you to contact us first to seek an informal resolution of any dispute. You may reach iGuard Home at CustomerService@iGuardFire.com or 844-859-3838. Most concerns can be resolved through direct communication.

If an informal resolution cannot be reached, any dispute, claim, or controversy arising out of or relating to these Terms, the website, the application, or any iGuard™ product shall be resolved through binding arbitration administered by a recognized arbitration body in the applicable jurisdiction. For customers in the United States, arbitration shall be conducted in King County, Washington. For customers in Canada, arbitration shall be conducted in Vancouver, British Columbia.

Arbitration shall be conducted on an individual basis. You and iGuard Home each waive any right to participate in a class action, class arbitration, or representative proceeding.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

Consumer Rights

These Terms do not limit or exclude any rights you may have under applicable consumer protection legislation in your state, province, or territory. Where any provision of these Terms conflicts with mandatory consumer protection laws, the applicable consumer protection law shall prevail to the extent of the conflict.

Residents of Quebec are advised that certain provisions of these Terms may be subject to the Quebec Consumer Protection Act, and any provisions found to be inconsistent with that Act shall be modified to the minimum extent necessary to comply.

Electronic Communications

By creating an account, placing an order, or contacting iGuard Home, you consent to receive electronic communications from iGuard Home, including order confirmations, shipping notifications, product safety alerts, account notifications, and responses to your inquiries. These transactional communications are necessary for the performance of our services and are not marketing communications.

Marketing and promotional communications are governed by the Marketing Communications and CASL section of our Privacy Policy at iguardfire.com/privacy.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms.

Entire Agreement

These Terms, together with the Privacy Policy (iguardfire.com/privacy), the Refund and Return Policy (iguardfire.com/returns), and the Limited Product Warranty (iguardfire.com/warranty), constitute the entire agreement between you and iGuard Home regarding your use of the website, application, and iGuard™ products. These Terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter of these Terms.

Modifications to These Terms

iGuard Home reserves the right to modify these Terms at any time. iGuard Home will notify you of material changes by posting the updated Terms on iguardfire.com with a revised effective date. Where required by applicable law, iGuard Home will provide additional notice.

Your continued use of the website, application, or iGuard™ products after the effective date of any changes constitutes your acceptance of the modified Terms.
